Policies Concerning the Treatment of Transgender Students
Lexington City Schools’ current district policies align with the relevant Virginia School Board Association (VSBA) policies which are in compliance with Va. Code section 22.1-23.3 requiring school divisions to enact policies that are consistent with the Department Of Education’s Model Policies for the Treatment of Transgender Students in Public Elementary and Secondary Schools as outlined in the May 2021, Number 180 VSBA Policy Page.
Regarding the legal requirement applicable to providing facility access to transgender students, the law is clear that transgender students must be allowed to use the restrooms and locker rooms for the gender with which they consistently identify and assert. Any student may request to use a private restroom within the school. Lexington City Schools will follow the law, as School Boards are required by law to “see that the school laws are properly explained, enforced, and observed.” Va. Code 22.1-79 (A)(1).
